Terms of service
These terms govern the use of ClicClac by hosts: whoever creates an account to manage check-in for their properties. They are offered by [company name], tax ID [NIF], [registered address].
1. The service
ClicClac reads your properties' calendars, asks each guest for what the law of the property's country requires, sends them their way in (a lock code, a key box code or your instructions) and, in Spain, reports travellers to SES.Hospedajes when you set it up.
2. Your account and your team
You sign in with your email, no password: keep your mailbox secure. You can invite other people to your account (Settings, Team & access); you decide what each of them can do and which properties they see, and you answer for what they do in your account. You can remove their access at any time.
3. What is yours
- Keeping the settings right: calendars, codes, arrival instructions and traveller-register codes.
- The duty to register your guests and report them to the authority on time stays yours. ClicClac helps you meet it and tells you on the dashboard when a report fails: check it.
- Having a legal basis to process your guests' data; the traveller-register law is one for the data it requires.
4. Availability
We do what is reasonable to keep the service running without interruption, but cannot guarantee it: it also depends on third parties (booking platforms, the lock maker, email delivery, the authorities). Always keep another way to let your guests in.
5. Price
During the free trial you pay nothing. Before charging anything we will tell you the price, and nothing is charged without your explicit agreement.
6. Liability
[Limitation of liability: for example, up to the amount paid in the last 12 months, except for wilful misconduct or gross negligence. To be completed by a lawyer.]
7. Closing your account
You can close your account at any time (Settings, Your data), where you can first download a copy of everything. It is deleted at once, traveller records included: if the law asks you to keep them (in Spain, three years from each stay), keep that copy. Our encrypted backups forget it within 12 months.
8. Data processing agreement (Art. 28 GDPR)
When you use ClicClac, you (the property) are the controller of your guests' data and [company name] processes it on your behalf as processor, on these terms:
- Subject and duration: your guests' check-in, sending them their way in and, if you turn it on, reporting to the traveller register, for as long as your account exists.
- Data and data subjects: the identity, document, contact and address data each country's form asks for, of your guests and those travelling with them.
- Instructions: we only process the data on your instructions, which are your account's settings.
- Confidentiality: whoever accesses the data is bound to secrecy. We do not enter your account unless you invite us to it (Team & access), which the activity log records.
- Security: the measures described in the privacy policy (Art. 32 GDPR).
- Sub-processors: those in the privacy policy. We will tell you before adding or replacing one, and you can object.
- Assistance: we help you answer your guests' requests and notify you without undue delay of any personal data breach affecting them.
- At the end: we delete the data or return it to you, except what the law requires us to keep.
- Audit: we give you the information needed to show we comply with these terms.
9. Changes and governing law
If we change these terms, we will tell you by email [30] days in advance. They are governed by Spanish law; [competent courts to be completed].
